1. How to place an order?
Our online store allows you to browse products at your leisure, regardless of store opening hours. We have compiled extensive information on our website for each product. If there is still something unclear, our partners are ready to help you, please contact vitali at vk@troxusmobility.com.
Do I have to register to visit the website?
You do not need to register after entering the website, that is, to open a customer account. You can find out in our Data Protection information how we process your data when visiting our website.
Will I receive a lot of advertising emails after subscribing to the website?
The clear answer: No. We do not see any point in providing you with information that you are not interested in and that annoys you. If you would like to receive special offers, our newsletter or the opportunity to participate in promotions, you can subscribe to our website for more details. In our Data protection statement, we explain who receives your information and for what purpose we use it.
What shipping options are available?
There are no other shipping options. We offer delivery and shipping services for all products, and delivery applies to all Troxus products.
2. How to buy a bike from us?
We have compiled extensive information on our website for each product. If there is still something unclear, please feel free to contact vitali at vk@troxusmobility.com, our partners are always at your service. We offer you a variety of options to get your dream bike:

You can buy the products you want from the distributors we cooperate with. If you want to get the products faster, you can contact vitali directly via email at vk@troxusmobility.com. Of course, there are no shipping or delivery charges.
3. Delivery method
(1) The goods are delivered by express (Schenker Logistics), for bicycles and electric bicycles, generally through the delivery of large goods (" home delivery ") delivery. Delivery time is about 2-3 days, you need to sign.
(2) Delivery takes place only in Germany.
(3) Purchase at Dealer stores: Buyers can also purchase e-bikes at Troxus dealer stores of their choice. Buyers can click on the "store search" option on the website to find the dealer store near the buyer, and then buy the product at the dealer store.
4. What if my delivery is defective?
Of course, we make sure that all products that leave our company are flawless. We offer a warranty of 24 months from the date of first sale for all Troxus products in the European Union (except for transmission systems and tyres). The contact for all warranty claims is always Vitali Kraus, the Troxus partner who supplied the product. Wear caused by the use of the bicycle does not constitute a defect, however, if the worn parts were already present at the time of purchase, we are of course liable for errors in the materials or workmanship of those parts. Damage caused by accidental damage and vandalism is usually not covered by the warranty. Unfortunately, we can never completely rule out the possibility of shipping damage. In rare cases, you will only notice a fault after using the bike for a while. Please report any shipping damage to us immediately.
If the shipping box is damaged, we recommend the following steps:

If the container is seriously damaged: refuse to receive the goods

If the case is damaged, it is not excluded that the bicycle or electric bicycle is damaged: the delivery is also refused

If the case is slightly damaged, but does not indicate any damage to e-bike, therefore the goods are accepted: Take a meaningful photo of the condition of the case in the presence of the delivery driver and note this on the delivery note (driver) and contact our customer service contact email. Ideally, you should also take a picture of the open box to show the stuffing and interior of the box. You can find the email address in the email we send you about your order.
This will help us enforce our claims against the freight forwarder. Regardless of shipping damage, you of course have all the legal claims you are entitled to make against us as a consumer:
If we are responsible for the damage, we will also replace the resulting damage. This provision does not apply only if we, one of our legal representatives or one of our agents has caused material or financial loss as a result of minor negligence and there has been no breach of basic contractual obligations. Basic contractual obligations are obligations that you can rely on to perform when executing a contract, otherwise the purpose of the contract cannot be achieved.
Our partners are not our agents.
Our liability under the Product Liability Act is completely unaffected.
5. I don't like e-bikes.
This has happened again and again. In this case, you, as a consumer, have thee-bikes following revocation rights.
Here is our cancellation policy:
If you choose a premium delivery service from a specialist retailer, the following rules apply:
Right of cancellation
You have the right to cancel this contract within 28 days without giving any reason.
The cancellation period is 28 days from the date on which you or your designated non-carrier third party takes over the last cargo.
In order to exercise your right to withdraw, you must contact Vitali Kraus, one of our administrators, at vk@troxusmobility.com, and provide a clear statement (e.g. by mail or mail letter) informing you of your decision to withdraw from this Contract. You can also use the model to cancel the table, but this is not mandatory.
In order to satisfy the cancellation period, you only need to send a notice of the exercise of the right to cancel before the cancellation period expires.
Consequence of revocation
(1) If you withdraw from this Contract, we must reimburse all payments we have received from you, including freight, immediately and at the latest within 28 days from the date of receipt of your notice of withdrawal. For this repayment, we will use the same payment method you used in the original transaction, unless you expressly agree to a different payment method. Additional costs incurred by using home delivery services will not be reimbursed.
(2) You must return the goods to us immediately. We usually have a pick-up service for bicycle returns. Please make an appointment with the Courier company in advance. If your order is a "store purchase" order, it will be returned to an authorized Troxus dealer store and in no event will the contract be returned or handed over no later than twenty-eight days from the date you notify us of the cancellation of this order. If you send the goods before the deadline of 28 days, the deadline is met. The bearer of the return freight will decide according to the reason of return. If the return is caused by the consumer's personal reasons, all expenses incurred by the return will be borne by the consumer himself. In the event of a return due to product quality problems, all costs arising from the return will be borne by the manufacturer (Vitali or PAONA EUROPE GmbH).
(3) The right of revocation does not apply to remote sales contracts for the delivery of sealed goods, which are not suitable for return for health protection or hygiene reasons if the seals have been removed after delivery.
(4) The right of cancellation does not apply to contracts for the delivery of non-prefabricated goods, as well as to production contracts where the consumer's individual choice or decision is decisive, or where the contract is explicitly tailored to the consumer's individual needs.
(5) The right of revocation is intended to allow you to examine the goods as you would in a shop, to check their nature, characteristics and functions and to give them a simple trial. If you use the goods beyond this scope and cause deterioration (including loss of value without any damage) or destruction of the goods, we will charge you appropriate compensation for this.
(6) Please avoid damage and contamination. If possible, please send the goods back to us in their original packaging together with all accessories and all packing components. Use protective outer packing if necessary. If you no longer have the original packaging, use appropriate packaging to ensure adequate protection against shipping damage to avoid claims for damage caused by improper packaging. To return the accessory, use the return form that came with the item and follow the instructions therein. But this is not a prerequisite for the effective exercise of the right to withdraw.

Keep Under Warranty
We are responsible for material defects in accordance with laws and regulations (in particular BGB §§ 434 ff). If we expressly state in the order confirmation, we only provide warranties beyond statutory warranty claims. We offer a warranty of 24 months from the date of first sale for all Troxus products in the European Union.
If the buyer contacts Troxus, Troxus will notify the buyer of stores located near the buyer's requested location in order to fulfill the warranty and check the warranty claim. Not all Troxus authorized dealers are authorized to service the goods (including warranty and warranty services). The eligibility of Troxus authorized dealers is determined by Troxus in its sole discretion.
If Troxus believes that Buyer is entitled to warranties and warranty repairs, the selected Troxus authorized Dealer will perform warranties and warranty repairs.
Force Majeure and Inability to Provide Services
(1) In the event of force majeure, Troxus shall cease to be liable for the performance of its delivery obligations and other contractual obligations, as well as for any damages or damages from the date on which the force majeure event constitutes an obstacle to performance, to the extent permitted by law, and for other contractual remedies against the breach during and to the extent of the existence of the event.
(2) Force Majeure events (" Force Majeure ") are events beyond Troxus' control that prevent Troxus from performing its obligations in whole or in part. Force majeure occurs in particular in the following circumstances (without excluding other circumstances) :

War, armed conflict and hostilities or their serious threat, as well as civil war, rebellion, revolution, military or usurpation of power and mob violence

Acts of terrorism, sabotage or piracy

Legal or illegal official acts, official orders, rules, regulations or instructions that prevent the Supplier from performing its obligations in whole or in part

Floods, earthquakes, wildfires and other natural disasters
-
Epidemics, epidemics, endemic diseases, epidemics and official measures such as quarantine orders
-
Explosion, fire or destruction of machinery, systems or production facilities, long-term failure of transport, telecommunications or electrical installations or routes
-
Strikes and legal lockouts.
Supply difficulties and other service interruptions between Troxus suppliers are considered force majeure because the supplier is unable to provide its required services as a result of the force majeure event in accordance with the second sentence above.
(3)Troxus will immediately notify the Buyer of the occurrence or cessation of force majeure and will use its best efforts to limit the impact of force majeure.
(4) In the event of force majeure, the parties will agree on how to deal with it and determine whether the products not delivered during this period should be delivered after the end of that period
(5) If the force majeure continues for more than eight weeks or if it proves that it will continue for such a period, the parties shall have the right to cancel the contract affected by force majeure. In the event of prolonged force majeure, the parties' right to terminate the contract with valid reasons shall not be affected.
(6) In the event that Troxus' suppliers/suppliers fail to deliver services or materials on time (the services are not available), Troxus will immediately notify the Buyer of this situation and notify the Buyer of their expected new delivery period. Troxus reserves the right to cancel the Contract in whole or in part if delivery or service is not possible within the new delivery period; Troxus must immediately reimburse Buyer for any monies paid.
Limitation of Liability
If we are responsible for the damage, we will of course compensate you for the damage caused. This provision does not apply only if we, one of our legal representatives or one of our agents has caused material or financial loss as a result of minor negligence and there has been no breach of basic contractual obligations. Basic contractual obligations are obligations that you can rely on to perform when executing a contract, otherwise the purpose of the contract cannot be achieved. This does not affect our liability under the Product Liability Act.
(1) We are liable for intentional and gross negligence. In addition, we are liable for (minor) negligent breaches of obligations, the performance of which is essential to the correct execution of the contract, the breach of obligations jeopardises the achievement of the purpose of the contract and the buyer often relies on its compliance. In the latter case, however, we are only liable for foreseeable contractual damages. Except for the obligations mentioned in the preceding sentences, we are not liable for breaches of obligations due to minor negligence.
(2) The above exclusion of liability shall not apply in cases of injury to life, body or health. Liability under product liability law is not affected.
(3) If a claim is made directly against the legal representatives and agents of the provider, the provisions of paragraphs 1 and 2 shall also apply to them.
(4) If we fraudulently conceal a defect or assume a guarantee of the quality of the goods, the limitation of liability provided for in paragraphs 1 and 2 shall not apply. The same applies if we have an agreement with the buyer about the nature of the item.
(5) Given the current state of technology, there is no guarantee that data communication over the Internet is error-free and/or always available (system error). In this regard, we are not responsible for the continued, uninterrupted availability of our online trading system.

Final Commission
(1) The law of the Federal Republic of Germany shall apply to these General Terms and conditions and to the fundamental legal relationship between GIANT Deutschland GmbH and the buyer, excluding the United Nations Convention on Contracts for the International Sale of Goods. The mandatory requirements of the buyer's country of habitual residence are not affected.
(2) If the Buyer has a place of residence or habitual residence in Germany at the time of conclusion of the contract and has moved at the time of filing of the action or the place of residence is unknown at that time, the jurisdiction of the Buyer's place of residence for all disputes is the headquarters of Troxus E-bikes. If the buyer's place of residence or habitual residence is not in a Member State of the European Union, the courts at the headquarters of Troxus E-bikes have exclusive jurisdiction over all disputes.
Final Legal Clause
We will revise these terms from time to time to reflect changes in case law or new legislation. As a registered customer, you will receive a message from us regarding this information. Otherwise, we will notify you when you place your next order. If you do not object to the change within four weeks, you will be deemed to have approved the latest regulations. Of course, with regard to the communication of the changed regulations, we would like to point out the need for timely objections and the resulting consequences.
Our online store is only for private customers in Germany. For orders from abroad, please contact us.
We would like to point out that we have decided not to participate in the dispute resolution proceedings of the Consumer Arbitration Board.

The entire legal relationship between you and Troxus is based on German law. The United Nations Convention on Contracts for the International Sale of Goods (CISG) does not apply.
